Man serving Jashore jail instead of real accused, family claims
Sabuj Biswas, a resident of Jashore Sadar upazila, has been serving jail for the last three months instead of the real accused in connection with a murder case, family claimed.
Police arrested Sabuj on February 17 as the lawmen found that his father’s name is similar to the father’s name of a fugitive accused named Kalo Jony, they told our Benapole correspondent.
Sabuj’s father Khairul Islam Biswas on Thursday submit a petition to the Jashore Additional District and Session Judge Court that had issued an arrest warrant against Jony earlier.
Taking the petition into its cognizance, the court issued a show-cause notice to the investigation office of the case. The court also ordered investigation officer of the case, its plaintiff and victim Sabuj Biswas to appear before it on May 22.
“The court has come up with the order as we submitted Sabuj’s driving license, nation ID card and other relevant documents in supporting his claim,” said Sabuj’s lawyer Mostafa Humayan Kabir.
Police has arrested Sabuj showing him as Jony, he told our correspondent.
One Mithu Sheikh was abducted on September 25 in 2009 from Pulerhat Bazar in the upazila and his body was found the day after the incident.
The victim’s brother Md Israfil filed a case with Jessore Kotwali Police Station mentioning manes of nine people including one Kalo Jony and his associate Ismail.
On completion of investigation into the case, Sohel Rana, assistant sub-inspector also investigation office of the case, submitted a charge sheet against five people, including Kalo Jony, before a Jashore court. Then, the judge of the Jashore Additional District and Session Judge Court issued an arrest warrant against Jony.
On February 17, police arrested Sabuj Biswas as they found his father’s name is similar with fugitive Jony’s father.
After being failed to ensure release of his son, Sabuj’s father Khairul Islam Biswas submit a petition to the court on last Thursday.
Sabuj’s father Khairul Biswas said his son, a truck driver by profession, was arrested by police and later sent to jail in connection with the Mithu murder case.
“I have tried several times to earn the faith of police that Sabuj is not fugitive Jony, but failed,” he said.
While talking to our correspondent, IO Sohel Rana said Sabuj identified himself as Jony when he was being arrested by police and local people know him as Jony.
“And thus, I arrested him based on the arrest warrant,” the police official said.
