HC clears way for 2 upazila chairmen to resume duties
The High Court today cleared the way for BNP-backed Mymensingh’s Phulpur Upazila Chairman Abul Bashar and Tarakanda Upazila Chairman Motaher Hossain Taluder to resume their duties.
The court stayed for three months the government orders that suspended Bashar and Motaher from their positions.
The bench of Justice Syed Muhammad Dastagir Husain and Justice Md Ataur Rahman Khan came up with the orders after hearing two separate writ petitions filed by the upazila chairmen challenging the legality of their suspension orders.
The court also issued two rules asking the government to explain in four weeks why its suspension orders against Bashar and Motaher should not be declared illegal.
The local government division on October 25 issued two separate notifications suspending Bashar and Motaher from their posts of upazila parishad chairman after a Mymensingh court recently accepted charges against them in connection with a criminal case.
Petitioners’ lawyer Barrister Ruhul Quddus Kazal told The Daily Star that there is no legal bar for Abul Bashar and Motaher Hossain to discharge duties as upazila chairman following the HC order.
