  Govt.'s petition rejected
The trial court has rejected the much-talked-about government petition for withdrawal of 10 of the accused from prosecution in the double murder case of Keraniganj.The court has also rejected bail prayer for Riazuddin Ahmed Moni, brother of Pintu, and Mehbub Ali, and fixed August 23 next for trial of the case. Judge of the Speedy Trial Tribunal-4 of Dhaka Md. Zahangir Alam Molla has passed the order hearing the counsels of all parties to the case. The court has observed that in the petition, the government did not mention any cause for such non-prosecution. The case cannot be considered as political harassment. Earlier the High Court issued a rule nisi on the government to show cause why the letter of the home ministry to the District Magistrate of Dhaka communicating government decision to withdraw charges against the 10 charge sheeted accused people in the Keraniganj double-murder case should not be declared illegal. A High Court Division Bench of Justice Shah Abu Nayeem Mominur Rahman and Justice Md Abdul Awal passed the order hearing a writ petition filed by Amir Hamza, the plaintiff of the double-murder case. However, at that time, the court refused the prayer for staying the proceedings of the case pending in the Speedy Trial Tribunal-4 of Dhaka. - Prothom Alo, 18 August.

Foreign prisoners languishing for years
Sixty-five Indian nationals are languishing in Jessore Central Jail though their conviction term expired two years back. These Indians also observed hunger strike earlier, demanding their release and repatriation, but that brought no result. The jail authority said they are awaiting government instruction regarding their release. After the official order of the government they will be handed over either to their relatives or to any voluntary organisation through the Deputy commissioner. But no initiative was taken by the authority concerned in the last to years to send them back to India. - The Daily Star, 17 August.

2500 cases decided by STA
Some 2500 cases has been disposed of under the Speedy Trial Act (STA) during the last 15 months. This data was flashed in a workshop in Khulna on 'Alternative Dispute Resolution' arranged by Legal and Judicial Capacity Building Project under the Law Ministry. Law and Parliamentary Affairs Minister Moudud Ahmed said that it was proved that quick disposal of cases was possible even with limited resource and in an unfavourable environment if the government has a good initiative. The workshop was presided over by Khulna District and Sessions Judge M Abdul Hai while Khulna City Corpoaration Mayor Tayebur Rahman, former Chief Justice Mostofa Kamal, Justice Anwarul Huq were present. -The Daily Star, 15 August.

Writ against GPA-based admission
A group of guardians has filed a writ petition with the High Court Division against the legitimacy of the government's circular on enrolling students on the basis of the grade point average (GPA). The government earlier this month issued a circular that students will be enrolled in colleges on the basis of the GPA. Father Benjamin de Costa, principal of Notre Dame College, earlier filed a writ with the High Court against the circular. After hearing the latest petition, the court issued a rule dispensing with the service of notice and fixed the next hearing together with the previous writ petition. The guardians along with four students filed the writ after the government challenged the legitimacy of authority of Father Benjamin de Costa for to file the writ. -Jugantor, 18 August

584 certificate cases filed
Bangladesh Krishi Bank Potuakali branch has filed 584 certificate cases in Artharin Adalat against the peasants who failed to repay the bank loan taken for agricultural purpose. These cases were filed to realise bank-loan of Tk. one crore four lakh and thirty-two thousand. Among these cases, 86 cases have been disposed of through which Tk. 49 lakh 86 thousand has been recovered. Earlier on 2001-2002 fiscal year to recover Tk. 52 lakh and 89 thousand 154 cases was filed. This year more two-certificate cases have been filed to realise Tk 12000. Bhorer Kagoj, 16 August.

Artha Rin Adalat realised Tk 24 Lakh
Artha Rin Adalat of Joypurhat has realised 24 lakh 69 thousand five hundred Taka. The court disposed of 51 case during the last fiscal year. Of the disposed of cases, 16 were settled during the last six months of the outgoing fiscal and Taka 22 lakh 21 thousand three hundred and 27 was realised in the process. The court issued warrant of arrest against 148-defaulter i8 the period and non-compliance of the warrant by the police has reduced amount of the money to be realised. - Independent, 18 August.

Law to curb noise pollution soon
Noise pollution is expected to bring under the control of law soon. Department of Environment (DOE) is preparing a draft of the proposed Noise Pollution (Control) Rules. The draft has suggested determining the maximum allowable limits of horns of the vehicles and sound amplifier and ultimate ban on the production, import and commercial use of such equipment that will exceed the maximum level of the allowable sound. The penalty for exceeding the noise level might also be increased from Tk. 2,000 to Tk. 10,000. Independent, 19 August.

Govt asked to decide on ETV within month
The High Court (HC) Division comprising Justice MA Wahhab Miah and Justice Shamim Hasnain has directed the government to decide on the Ekushey Television Ltd.'s (ETV) application for a new licence and frequency for satellite operation and return the channel's seized equipment in 30 days. The ETV, the first private terrestrial TV channel was shut down following a Supreme Court verdict on August 29 last year that declared the channel's licence illegal after 28 months on the air. The government seized the ETV equipment on the heels of the verdict. Prothom Alo, 21 August.

Notice on OCs for negligence
Two separate show cause notices have been issued against the officers-in-charge of Sadar and Khetlal police stations of Joipurhat district Iqbal Shafi and SM Nurul Haque, for neglect of duty. The two officers, who had led the raid on Moheshpur village in Joypurhat on August 14, were asked to show cause within five days as to why they failed to capture the militants and protect police forces. In the notices issued by Superintendent of Police (SP) of Joypurhat, they were also charged with ignoring orders of superior officers. Departmental investigation into the incident found that six policemen were injured because of the negligence of the two officers. Daily Star, 19 August.

Advocacy for separation of judiciary
Members of the Rajshahi University Association of Law Finders (RUALF) brought out a procession on the campus demanding separation of judiciary from the executive. RUALF president Shafiul Alam and general secretary Shariful Haque led the procession. Earlier, they organised a tree plantation programme in front of the Law and Justice Department. Law Faculty Dean A F M Mohsin inaugurated the programme. Law and Justice Department chairman Prof Dr Begum Asma Siddika, Professor A B Siddik, Professor M Rabiul Hossain, Pref Abdul Hassan, Prof Anisur Rahman and Prof Hasibul Alam Prodhan participated in the tree plantation programme. - Law Desk.

Human traffickers arrested
The Criminal Investigation Department (CID) of the police arrested two for their alleged involvement in trafficking women. A team of the CID police arrested the persons from the departure of the lounge of the Zia International Airport. They also rescued three women from the airport while they were waiting for a Lebanon -bound flight. The rescued women, who were from Manikgonj district, said that the trafficker took money from them on condition of arranging good jobs for them in Lebanon. - The Financial Express, 16 August.
