Kamal Majumder's detention valid as SC stays HC order

The Supreme Court (SC) yesterday stayed for five days the operation of the High Court (HC) verdict that declared illegal the detention of former Awami League lawmaker Kamal Ahmed Majumder and three others.A four -member full bench of the Appellate Division, headed by Chief Justice (CJ) Syed JR Mudassir Husain, on his last day in office pronounced the order. Although the CJ issued the order, he said the hearing on the matter will resume on Monday. The stay order, which was issued halfway the hearing upon a government petition, triggered resentments among the lawyers present in the court. At one stage, former law minister Moudud Ahmed, counsel for one of the four detainees, left the courtroom in protest. On February 26, a High Court bench declared illegal the detention of Kamal Majumder and three others under the Special Powers Act. Kamal Majumder and three others were arrested by the army-led joint forces. On January 11. Later, they were sent to jail with a 30-day detention order. Within a couple of days, close relations of the detainees filed habeas corpus petitions with the High Court, challenging the detention orders. After hearing the petitions, the High Court declared their detention illegal.
