Boycott of lawyers challenged

Boycott of the chief justice's court was challenged yesterday in the High Court by three senior lawyers saying, the decision of the Supreme Court Bar Association (SCBA) was ulta vires the fundamental rights. Mahbubur Rahman MP, Habibul Islam Bhuiyan and MA Wahab in their writ said the SCBA by taking the harsh decision has infringed their fundamental right to legal practice. A bench comprising Justice M Joynul Abedin and Justice Nirmalendu Dhar took up the matter for hearing when SCBA President Barrister Rokanuddin Mahmud raised objection for its maintainability. He contended that this court could not hear the writ, as the junior judge (Justice Dhar) of the bench is the subject matter of boycott of the court. Barrister Abdur Razzak, counsel for the petitioners, conceding to the contention of Barrister Rokan sought to take back the writ. The court granted the prayer. Coming out of the court, Barrister Razzak told the newsmen that he would move the writ in another bench. He said the lawyers have the right to practice in the courts. But the SCBA has taken away the right and imposed punitive measure of cancelling the membership of the Bar if any lawyer defied its decision. The SCBA in its general meeting on Aug 29 adopted a resolution to boycott the chief justice's court as he ignored the lawyers' demand for cancellation of the swearing-in of 19 additional judges appointed on what they said were political grounds.
